After an initial pause in most dispute proceedings due to the worldwide pandemic, it started to become clear – to Courts, law firms, and disputing parties – that waiting for a return to "normal" was not going to be a practical strategy. Thankfully, a few national providers of dispute support services recognized the situation early enough to put in place the tools needed to conduct efficient and effective remote depositions, hearings, trials, and arbitrations.

FTI Consulting is one of the trial support providers who recognized the challenges early on and began working with its clients to identify and resolve the many challenges of a remote proceeding. In this presentation, the professionals who participated in the development of those solutions will discuss the most significant challenges, along with the tools and key best practices needed to go well beyond a simple zoom proceeding – to create an experience as close to live as possible, allowing attorneys to continue using the skills they developed in pre-pandemic, live proceedings with minimal adjustment. The presentation will discuss technical considerations, participant training and preparation, managing the proceeding, and document handling before, during, and after the proceeding.
